Rules for using this website and general information about working with Dead River Management. A signed client agreement controls if it differs from these website terms.
Agreement to these terms
By using this website, you agree to these terms and our Privacy Notice. If you do not agree, do not use the site. You must be legally able to enter into an agreement and use the site only for lawful business purposes.
Website use and prohibited conduct
You may use this site to learn about our services, use our free tools, and contact us. Do not interfere with site security or operation, attempt unauthorized access, introduce harmful code, scrape or harvest information in violation of law, impersonate another person, submit unlawful or misleading material, or use the site to violate another person’s rights.
Intellectual property
The site, brand, copy, designs, graphics, tools, calculations, workflows, and other materials are owned by Dead River Management or used with permission and are protected by applicable intellectual-property laws. You may use the site for your own internal evaluation. You may not copy, resell, publish, reverse engineer, or create derivative commercial products from our materials without written permission. Client ownership and license rights are governed by the signed client agreement.
Plans, pricing, and signed agreements
Foundation is $997 a month with setup from $1,497. Growth Partner is $2,497 a month with setup from $1,997. Scale starts at $4,497 a month with setup from $2,997. Setup may be higher when the work requires it, and we confirm scope and price before signing. Ad spend is paid separately. Every plan starts with a three-month commitment, then continues month to month with 30 days written notice unless the signed agreement says otherwise. Dead River Demand Intelligence is a separate product at $3,000 a month with no setup fee and its own agreement.
Scope and client responsibilities
Full website rebuilds, major rebrands, photo or video production, custom software, complex integrations, large-scale content production, and extensive manual outbound are quoted separately unless included in writing. Clients must provide accurate information, required access and approvals, agreed advertising funds, and lawful instructions and content. Delays in access, approvals, or funding may delay launch dates, performance windows, and delivery.
Tools, estimates, and results
Free tools and calculators provide estimates based on information entered and are for general planning, not legal, financial, accounting, or investment advice. Case studies describe particular clients and periods. Past performance does not guarantee future results. No lead, revenue, profit, ranking, or advertising result is guaranteed unless a specific written guarantee is included in an eligible client agreement.
Third-party services and links
The site and our services may use or link to third-party platforms. We do not control their availability, security, policies, content, pricing, or decisions. Your use of third-party services may be governed by separate terms, and we are not responsible for a third party’s acts or omissions.
Website availability and disclaimer
We try to keep the site accurate and available, but information may become outdated and the site may be interrupted, changed, or removed. To the fullest extent permitted by law, the website and free tools are provided “as is” and “as available” without warranties of uninterrupted operation, accuracy, merchantability, fitness for a particular purpose, or non-infringement.
Limits of liability
To the fullest extent permitted by law, Dead River Management and its owners, employees, and contractors are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, opportunities, or jobs arising from use of the site or free tools. Nothing in these terms excludes liability that cannot legally be excluded. Liability for paid services is governed by the signed client agreement.
Your responsibility for misuse
To the extent permitted by law, you agree to defend and reimburse Dead River Management for third-party claims, damages, and reasonable costs caused by your unlawful misuse of the site, your violation of these terms, or content you submit that violates another person’s rights.
Governing law, changes, and severability
Texas law governs these website terms, without regard to conflict-of-law rules, and disputes relating to the website will be handled in state or federal courts located in El Paso County, Texas unless another written agreement controls. We may update these terms by posting a revised version and updated date. If one provision cannot be enforced, the remaining provisions continue in effect. Failure to enforce a provision is not a waiver.
